FAQ
1.1. The creator or seller registered on Kin Power undertakes to deliver the product or provide the service under the terms, conditions, timeframes, and characteristics indicated in the corresponding product page or listing.
1.2. When the creator or seller fails to deliver the product or provide the contracted service, the buyer shall be entitled to a full refund of the price paid for the product or service, as well as the original shipping costs, provided that the transaction is eligible under these Terms and Conditions and the claim is made within the time limits and subject to the requirements established by Kin Power.
1.3. In the event of a claim for non‑delivery, the creator or seller must respond and offer a solution (refund, reshipment, or another alternative acceptable to the buyer) within the period established by Kin Power. If the creator or seller does not respond or does not provide a satisfactory resolution, Kin Power may intervene, decide the case, and refund the buyer directly, and the creator or seller shall then be obliged to reimburse Kin Power for the corresponding amount.
1.4. Kin Power reserves the right to record the non‑delivery as a “transaction defect” and/or a “case closed without seller resolution” and to use such records for the seller’s or creator’s performance assessment. Kin Power may adopt corrective measures, including, without limitation, feature restrictions, temporary or permanent account closure, and the withholding of pending funds.
2.1. The creator or seller must deliver the product exclusively to the address indicated in the order details or make the product available for collection at the place and under the conditions communicated in the transaction.
2.2. If the buyer states that the product has not been received, the creator or seller must provide, through the platform, sufficient and verifiable proof of shipment and/or delivery (for example, a tracking number and delivery confirmation issued by the carrier) within the period established by Kin Power.
2.3. If the creator or seller does not provide sufficient proof of shipment or delivery and the buyer maintains their claim, Kin Power may resolve the dispute in favor of the buyer and order a full refund of the amount paid, including the original shipping costs, provided that the transaction meets the coverage conditions defined by Kin Power.
2.4. In cases where, after the refund, it is conclusively proven that the product was delivered in accordance with the agreement, Kin Power may, at its sole discretion, adopt seller‑protection measures, without this implying an automatic obligation of compensation.
3.1. All creators and sellers on Kin Power are subject to the performance standards defined by the platform, which include, among others, maintaining low rates of transaction defects, non‑delivery claims, and cases closed without seller resolution.
3.2. Kin Power may periodically evaluate each creator’s or seller’s account metrics. When these metrics exceed the maximum thresholds that Kin Power considers acceptable, the platform may apply corrective measures such as warnings, selling limits, visibility restrictions, account level downgrades, fund holds, temporary suspension, or permanent account closure.
3.3. The following shall be deemed serious breaches of these Terms and Conditions:
a) Repeated failure to deliver products or provide services.
b) Publishing descriptions that are false, misleading, or incomplete.
c) Manipulating proof of shipment or delivery.
d) Any other conduct that, in Kin Power’s judgment, may constitute fraud, abuse, or an attempt to defraud buyers or the platform itself.
3.4. Kin Power reserves the right to withhold, offset, or claim funds from creators and sellers to cover refunds, chargebacks, or other obligations arising from valid buyer claims, in accordance with applicable law and the rules of the payment systems used.
4.1. The creator or seller undertakes to provide, within the timeframes stated in the listing, the information and documentation necessary to prove fulfillment of their obligations, including, without limitation:
a) Tracking number and shipping details for physical products.
b) Access codes, licenses, download links, activation logs, or other verifiable elements for digital products or services.
4.2. Product and service descriptions published on Kin Power must be clear, complete, and truthful. The creator or seller undertakes that the product or service delivered will be substantially equivalent to that described in the product page or listing.
4.3. The creator or seller must comply with the return, refund, and warranty policies stated in the listing and in these Terms and Conditions. Failure to comply with such policies may result in forced refunds in favor of the buyer and the imposition of sanctions on the creator’s or seller’s account.
5.1. Kin Power will offer buyers a money‑back guarantee for those transactions that meet the eligibility criteria defined by the platform when:
a) The product is not delivered; or
b) The product or service is substantially different from its description; or
c) The creator or seller fails to comply with their own delivery, return, or service policies.
5.2. In such cases, and after reviewing the claim, Kin Power may refund the buyer in whole or in part, and the creator or seller shall ultimately bear the cost of such refund, without prejudice to any other contractual or legal liabilities that may apply.
5.3. The following conduct is expressly prohibited on Kin Power:
a) Fraud, scam, or any attempt to obtain an undue benefit through deception.
b) Deliberate non‑delivery of paid products or services.
c) Identity theft, use of false data, or creation of accounts with untrue information.
d) Any action aimed at circumventing or manipulating Kin Power’s protection, evaluation, or reputation systems.
5.4. Without prejudice to any civil, administrative, or criminal actions that may apply, Kin Power may cooperate with competent authorities and financial or payment entities, sharing only the information strictly necessary where there are reasonable indications of fraudulent or unlawful conduct.
